BRIEF: Butte building owner loses lawsuit against ARCO
Dec 07, 2012 (Menafn - The Montana Standard - McClatchy-Tribune Information Services via COMTEX) --A jury didn't find the Atlantic Richfield Co. responsible for subsidence damages to an historic apartment building in Butte Friday evening.
The jury ruled 11 to 1 in favor of Atlantic Richfield Co. (ARCO) after deliberating for about two hours that afternoon. As a result, ARCO will pay no monetary damages to Jody Barile, who sued ARCO for damages she claimed the company was responsible for to her building, the Tripp and Dragstedt.
Barile claimed in the lawsuit that mining subsidence caused irreparable damage to her building at 436 S. Main St. due to underground mining by the Anaconda Co. ARCO purchased the Anaconda Co. in 1977.
The civil suit trial started Monday in Butte District Court.
