Saudi- Custody of 4 children passed to father over mistreatment charge


(MENAFN- Khaleej Times)  Al Ain personal status Court of Appeal has ordered the custody of four children, who were earlier handed to their mother, be forfeited on the grounds that she mistreated them. The decision was made in order to maintain the psychological health of the children after it became apparent that she used to beat and neglect them. The court has ordered their father, whom they are close to, gain full custody of the minors, aged between 7â€"10 years. According to court records, the couple agreed to divorce and accordingly the court awarded the mother custody of the children as per the law. Subsequently, the father was ordered to pay child support, provide them with a house to live in as well as a car and a housemaid. Suspicions were aroused when the children refused to be handed over to their mother after the social care centre tried to reunite them on 15 separate occasions. In a report filed by the social care centre submitted to court, it stated that they failed to surrender the children to their mother as they looked scared and frightened when she was due to take them from the centre. The children, the report said, were unwilling to see their mother, even when the social care centre promised to supply secure guards during the visitation. They requested to stay with their father, whom they loved dearly, claiming that they were fed up of moving between care centres. According to the report, the children claimed that their mother used to beat them and burn her daughter with an iron. They alleged that their mum neglected them and would leave them in the house, alone, on a regularly basis. The medical report issued by the medical panel assigned by the court to check on the psychiatric state of the four children, manifested that they suffered from emotional problems as a result of the ill-treatment. The report indicated that the children's relationship with their parents was not normal, characterised by the mother's failure to show them love, and their exorbitant affection to the father. Earlier, Al Ain personal status Court of First Instance passed down a ruling suspending the first verdict issued in favour of the mother that had granted her custody of children. The court issued such a verdict in order to prevent the children from being passed around from care centre to care centre, claiming that it could affect their psychological state and educational status. The court viewed that the attempts made to hand the children over to the social care centre frequently affected the children's mental health and ordered it be stopped. The mother appealed the lower court's verdict, but the court upheld the ruling. Based on the latest court ruling, the father moved the court demanding custody of the children, and as a result it ordered the forfeiture of the mother's custody and passed it on to the father. The court has also ordered the child support, house, car, and housemaid wage the mother earlier had won be dropped.
