UAE- Labourer on trial for assault leading to workmate's death


(MENAFN- Khaleej Times) A labourer died due to heart complications after having a fight with a work mate over a water pump on a farm in Hatta, a court heard. According to court records, the victim was assaulted by another labourer with a solid tool and received a head injury and died shortly later in hospital because of his heart condition. The defendant, a 22-year-old Bangladeshi, denied the charge of assault leading to death when he appeared in the Court of First Instance. He claimed he did not intend to kill the victim and that he was also beaten. The farm's Emirati owner, a retired school director, said that on November 29 last year he was called up to the farm after a fight broke out between labourers at his farm around 4pm. "I saw the victim lying down. He was still alive. He was bleeding from a head injury. The accused was standing and appeared with a head injury and scratches in the back of his head." There was a medicine bag next to the victim who is known to have a heart condition. He was taken to hospital and died shortly later. A Bangladeshi driver, 35, testified that he saw the victim gasping for breath after the incident. "He had a head injury and was bleeding. I told him to stand up to be taken to hospital but he could not because of his heart illness." The driver added that the paramedics tried to revive the victim with an apparatus but in vain. A police lieutenant said that the victim had already been rushed to hospital when he reached the farm. He learnt later that he died in the hospital. He quoted the defendant as saying that he had a verbal brawl with the victim over closing a water pump at the farm where they worked. It evolved into a physical fight. The forensic report found the victim died due to a heart attack. He was assaulted with a solid tool but it was not the cause of his death. "He had a blood clot that blocked the arteries which pumped blood into the already ill and narrow heart muscles.
