Kuwait- Return cash, couple ordered


(MENAFN- Arab Times) The Court of Appeals presided over by Judge Khalid Al-Hindi upheld the verdict of the First Instance Court which ordered a couple to cancel the contract signed between them and a citizen over the sale of a farm in Sultanate of Oman and refund KD 155,000 which the citizen paid them for the farm. Plaintiff attorney Lawyer Mohammad Al-Majidi informed the court that the couple sold their farm located at Abra province of Oman to the citizen for KD 155,000. The citizen paid the amount via two cheques, which were cashed out by the couple. Article 4 of the sale contract signed between the two parties stipulated that the seller will follow-up with the paperwork process for transferring the ownership of the farm, while Article 6 stipulated that they will produce the change of ownership documents attested by accredited Omani governmental agents. Lawyer Al-Majidi said after his client paid for the farm, the couple showed reluctance in completing their side of the contract even after being served with official warning letters. He added that his client filed a report at one of the police stations in Kuwait after discovering that the couple did not own the farm.
