Kuwait- Opposition take on 'procedures'


(MENAFN- Arab Times) The opposition MPs continue to challenge the constitutional procedures laid down before new parliamentary elections take place. They argue there is no justification for the government to resign to correct the 2009 Parliament dissolution decree as stated in the Constitutional Court ruling that the government cannot dissolve the Parliament unless after its resignation. This was in response to a statement issued by Speaker of the Parliament Jassem Al-Kharafi who returned last Wednesday to 'correct' the constitutional procedure according to which a new government must take the oath of office before the reinstated Parliament after which it can be dissolved to pave way for new parliamentary elections. MP Musallam Al-Barrak argues from the legal and constitutional point of view the previous government could dissolve the 2009 Parliament without the need to resign "because it was a constitutional government which was sworn in before HH the Amir and because the dissolution of the Parliament is an executive procedure not legislative." He stressed, in this respect the government does not need at all to take oath before the National Assembly except for its participation in the legislative work on the grounds that ministers are members of the Parliament in accordance with the Constitution. On the political front Al-Barrak described the 2009 Parliament as 'bribe-taker' that was toppled by the Kuwaiti people "but it is clear that there are those who want to beat around the bush and force the current government to resign and take the oath of office before the disgraced and shameful Parliament. We know this was predicted by well-known parties who play for time for their own interest. He stressed Kuwaitis cannot accept to see the Members of the 2009 Parliament setting their foot again in the Abdullah Al-Salem Hall. He added, Kuwaitis will feel provoked when the new government after swearing before HH the Amir going to the 'contaminated' Parliament for the swearing-in ceremony. He stressed the government can issue a decree to dissolve the 2009 Parliament without the need of going to the disgraced and shameful Parliament because an executive procedure requires oath-taking before HH the Amir only. Meanwhile, MP Faisal Al-Mislem disclosed the MPs from the majority bloc have come to an agreement to contest the next parliamentary elections. They explained the move is to run the elections through two electoral lists in each constituency so that each constituency includes four members, meaning that the majority bloc will contest the elections with 40 candidates in the five constituencies. He expects the majority bloc to launch its election campaign from Erada Square and a headquarters in each constituency district. He pointed out the bloc has a reform vision to save Kuwait from the cycle of crises. The bloc will also prepare a plan (a document) and will soon announce a timetable for its adoption. On another issue, former MP Osama Al-Munawer warned the government will plant seeds of dispute in the next Parliament if it pays the Dow Chemical Company $2.16 billion when the Parliament is not in session. He said it is surprising the government has not even appealed the verdict.
