(MENAFN- Khaleej Times) A system that allows the public prosecution to settle minor offence cases by imposing fines, instead of referring the defendant to court, has come into effect in Dubai.
Implemented about two weeks ago, some residency cases have already been settled using the system. It will be in place at all police stations across Dubai to settle minor cases by replacing trials with fines.
As reported by Khaleej Timeson Monday, several types of minor offences are covered, such as bounced cheques, minor traffic cases, non-payment of bills and dues, and insults (exception of insult of public officers and relevant cybercrimes).
Under the new system, minor offences will only take a few hours to settle, saving time, efforts and costs for all parties concerned, while respecting the rule of law and guaranteeing justice. It will alleviate the burden of cases' flow on courts.
The system comes pursuant to Law No. 1 of 2017, issued by His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice-President and Prime Minister of the UAE and Ruler of Dubai, which serves to enhance the judicial performance in general.
Essam Issa Al Humaidan, attorney-general of Dubai, issued the executive decisions to start implementing the new system. It comprises the modalities of notifying the defendant of the date the complaint is presented to the competent prosecution; the types of minor offences and misdemeanor cases; and fine amounts to be imposed by the specially-assigned members of prosecutions of Deira, Bur Dubai, Family and Juvenile, Naturalisation and Residency, and Traffic.
The decisions also regulate the procedure through which the fines shall be collected and the way the defendant can object to an order.
