(MENAFN- Arab Times) KUWAIT CITY, Oct 26: The Court of Appeals has nullified the verdict of the First Instance Court that sentenced a Kuwaiti man in absentia to 10 years imprisonment with hard labor for allegedly raping an Asian housemaid. The court thereby refrained from pronouncing penalty against the suspect. The case file indicated the housemaid was in the kitchen cooking for her sponsor when the suspect touched her sensitive parts, so she shouted and went into her room to take a shower. To her surprise, the man followed her to the room and had sex with her by force.
She stressed the suspect thanked her thereafter and left the room. She claimed the same man raped her two weeks earlier after grabbing her by the hair. Lawyer Abdul-Wahab Bin Salamah defending the suspect faulted the investigation, saying the officers declined to question the suspect's mother. He declared the statements of the plaintiff were inconsistent with the legal medical report, while his client vehemently denied the allegation. He insisted there was no concrete proof to substantiate the plaintiff's claim.
Hearing Nov 16: The Criminal Court adjourned until Nov 16, 2017 the session on a lawsuit filed against 14 individuals for sheltering their relatives who were involved in the Abdali Cell case. They are also charged with spying for Iran and committing aggressive actions against the State. In the last session, 11 of the accused were present and three were absent. All of them denied the charges and their lawyers asked the court to adjourn the session as they need more time to obtain a copy of the case file and read it. Investigations of security authorities showed that the 14 individuals harbored 25 of those involved in the Abdally Cell case and helped them hide in different places. It is worth mentioning that the Court of Cassation commuted the death sentence imposed by the Court of Appeals on one of the accused in the Abdally cell case to life imprisonment. The Court of Cassation also cancelled the decision to acquit 15 of the accused in the lawsuit involving 25 citizens and one Iranian who escaped, and then sentenced them to 10 years imprisonment. The court sentenced two of the accused to 15 years imprisonment, three to five years imprisonment and upheld other decisions of the Appeals Court.
