Kuwait- Ruling in increase of fuel price by govt on Thursday


(MENAFN- Arab Times) KUWAIT CITY, Sept 25: The Court of Cessation Monday decided to adjourn to next Thursday the ruling on the appeal filed against the government's decision to increase the fuel prices. Earlier, the Court of Appeals had overturned the verdict issued by the lower court to suspend the Cabinet's decision which was issued on Aug 1, 2016.

During the court session, Lawyer Ali Al-Ali, who was present along with Lawyer Nawaf Al-Fazai, urged the court to accept the appeal by overturning the verdict of the Court of Appeals. He stressed that the appellate court's verdict did not properly consider the reasons specified in the initial submission based on which the lower court managed to find fault in the government's action in this regard. Previously, the Court of Appeals had rejected the appeal to cancel the Cabinet's decision to increase the fuel prices, which came into effect on Sept 1, 2016, on the grounds that the Cabinet used proper legal channels and had the authority to take such decision.

This was contrary to the appellant's argument that the Cabinet overstepped its mandate on this regard. The court affirmed that the decision taken by the Cabinet was part of the constitutional mandate granted to the Cabinet, as it is the representative of the state in utilizing the resources of the country. Therefore, its decision was legally and constitutionally covered.
