UAE- Cop jailed for detaining businessman illegally


(MENAFN- Khaleej Times) A police lieutenant has been sentenced to three months in jail for unlawfully detaining a man at Al Qusais police station.

The 25-year-old Saudi officer, S.A., has been found guilty by the Court of First Instance of detaining an Indian businessman in an unlawful way and making him, under threats, issue a cheque worth Dh105,000. The businessman had earlier received the amount from a compatriot, I.S., as a down payment for buying his shop.

I.S., 22, who was accused of aiding and abetting S.A. in committing the crime, has also been sentenced to three months in jail.

According to prosecution records, the case dates back to March 22, 2015.

The businessman, 39, said I.S.'s father went to his general trading company and said he wanted to buy the shop for Dh335,000. "On the following day, he handed me Dh105,000 as down payment and asked me to start the necessary procedures to transfer the ownership of the company to him. He said he would settle the remaining amount later."

However, two days later, the man informed him that he did not want to buy the company anymore. "I told him to give me few days to return the sum because I had spent a part of it and he agreed."

One week later, he received a call from the lieutenant telling him to go to Al Qusais police station. "There, the officer asked me whether I received any sum from I.S.'s father and told me to return it immediately."

But when the businessman insisted that he did not have the money, the officer locked him up in a detention cell after taking away his mobile phone, wallet, watch and belt.

Over an hour and a half later, the complainant was taken out of detention and he issued a cheque to I.S. in the presence of I.S.'s lawyer, police officers and the complainant's business partner.

The complainant later informed the Human Rights Department of the Dubai Police about his problem and they registered his complaint.

He filed a complaint with the public prosecution after failing to solve the problem amicably.

The verdict remains subject to appeal by the defendants and the public prosecution.
