Michael Daugherty Founder President and CEO of LabMD speaks to Government and IT Business Leaders for the first time after landmark court ruling at November 2015 GTRA Council Meeting.
GTRA November 17 2015 – Founder President and CEO of LabMD and author Michael Daugherty discussed his major win against the Federal Trade Commission at GTRA’s SecureGOV summit yesterday. After seven years of litigation court battles and testimonials ALJ ruled in favor of LabMD determining that the FTC failed to provide substantial evidence of any theft-related or emotional harm in the aftermath of an alleged security breach.
As Daugherty discussed regulators do not work in the fields they are regulating. This creates a “they don’t know what they don’t know” culture which Daugherty described as a “Petri dish for corruption.” Unfortunately this case demonstrates that there is no good answer of what’s good enough when it comes to securing private information. The government is not going to tell organizations what they have to do to comply with regulations – it creates a “secret law” and companies are left guessing what to do.
Daugherty highlighted during his GTRA SecureGOV keynote address that the process and outcome of this decision just go to show the important of collaborative regulations over strictly punitive ones. Daugherty’s solution to this ever-increasing tension between transparency and compliance: 1) Realize that the private sector’s current compliance strategies are not enough for the government and 2) recognize the importance of collaboration in security/privacy regulations. This perspective and awareness says Daugherty is the first step to creating more involvement and partnership between regulatory entities and the private sector.
