MLM Legal Expert Exceeds 1000 Clients
Tony Davis Australian Barrister and Solicitor is one of if not the worlds most experienced MLM/Network/Direct Sales lawyer. A former adviser to the Direct Sales Association of Australia in the early 1970s he has since advised over 1000 MLM /Direct Sales/Network clients. Tony has also been successful in some of the most important Australian cases that have had industry wide ramifications including The World Book Case World Book (Australia) Pty Ltd v. FC of T 92 ATC as it came to be known involved the Australian Tax Office claiming withholding tax from commissions paid to approximately 6200 World Book independent agents. The industry wide loss of such a case could have involved hundreds of millions of dollars in lost tax revenue the ATO claimed..
After many years in court the New South Wales Court of Appeal determined unanimously in favor of World Book. The winning argument was ultimately that World Book was not responsible for withholding tax as the agents where paid on a results only basis and where true independent contractors.
Tony was also involved in the Troubleshooters cases(1991) 99 ALR 735 and (1991) 29 FCR. 104.
Where it was held that independent agents had the right to be self-employed in the building industry. The outcome of this case inspired Tony to corresponded with the then Australian Prime Minister John Howard for the introduction of an Independent Agents Act. This ultimately did become law and protects the legal rights of independent agents.
With the assistance of his New Zealand associate solicitor Kelly Tudhope Tony is now involved in drafting compliance programs and editing compensation plans to ensure companies meet the legal requirements for Australia and New Zealand. Via his new venture Direct Sales Consultants International Tony is offering non-legal services to MLM/Direct Sales/Network clients worldwide.
