INDONESIAN MARINE WATERS 4 MILES Susi Oversteps The Law

JAKARTA February 12 2015—Ministry of Maritime Affairs and Fisheries (KKP) is considered not having the authority to regulate maritime zone 0-4 miles from coast because the authority lies in the hands of regional government.

Based on a Law No. 23/2014 Article 27 Paragraph 3 concerning Regional Government the provincial government is authorized to manage maritime resources for the farthest of 12 nautical miles measured from the shoreline out to the sea and/or in the direction of the archipelagic waters.

Based on the Law Secretary General of Indonesian Marine Aquaculture (Abilindo) Wajan Sudja said the Ministry of Maritime Affairs and Fisheries is not authorized to regulate maritime zone 0-4 miles from coast through ministerial regulation.

“It is not her authority. The regional autonomy law must be examined first” he told Indonesia Business Daily Wednesday (2/11).

Vessels with size over 5 gross tonnages (GT) will be prohibited gradually from operating in maritime zone 0-4 miles from coast. This is intended to sustain the maritime ecosystem.

Moreover intensive pond will also be banned in maritime zone 0-4 miles from coast because the pond waste could disrupt marine biota in the area.

Ministry of Maritime Affairs and Fisheries will gradually restrict fish catching in maritime zone 0-4 miles from coast.

Based on KKP’ data the number of vessels with size below 30 GT reached 391208 units. It consists of 110163 vessels with size below 5 GT 31460 vessels with size of 5-10 GT 10988 vessels with size of 10-20 GT and 7264 vessels with size of 20-30 GT.

If this policy is applied vessels with size of 5-20 GT will also be affected since it cannot sail further. Read more
