UAE- Sharjah Public Prosecution chief fired over disobeying order


(MENAFN- Khaleej Times) The judge confirmed that the Sharjah Public Prosecution chief had not obeyed the Attorney-Generals order which was in contravention to his duties and left the decision to the minister.

Abu Dhabi — The services of the Sharjah Public Prosecution chief were terminated for refusing to follow the decision of the Attorney-General who transferred him to the Public Prosecution of another emirate.



The decision was a disciplinary action for he had absented himself from work for more than three years without acceptable and valid reasons nor did he justify his absence.



The Minister of Justice who is also the Chairman of the Federal Judicial Council had ordered a judge from the Federal Supreme Court to open an investigation into the conduct of the Sharjah Public Prosecution chief.



In his report the assigned judge confirmed that the Sharjah Public Prosecution chief who is also a member of the judicial authority had not obeyed the Attorney-General’s order which was in contravention to his duties and left the decision to the minister.



The Federal Attorney-General was asked to file a lawsuit to discipline the member and send the same to the judicial disciplinary council.



According to the lawsuit the sacked judiciary member had refused to carry out the order. He had submitted an application for six weeks’ sick leave which was granted to him but it expired on November 13 2010. He had not resumed work since then without justification or acceptable excuse.



He argued that a decision on his transfer should have been issued by the Federal Supreme Judicial Council so the decision of the Attorney-General was null and void which the court viewed as a lame excuse.
