The 53-year-old Indian doctor identified as R.S. denied the charge in the Court of First Instance.

According to a letter from the Dubai Health Authority (DHA) dated March 20 2013 necessary legal action was taken against R.S. for violating article 9 of the Medical Liability Law which states: “No patient’s life may be taken for whatever reason not in respect for his will or upon any of his family members’ request.” The incident dates back to January 5 2012.

Prosecutors said the Indian patient 64 died at the hospital in Al Garhoud after the medical team which R.S. was in charge of failed to resuscitate her. The patient had cancer and it spread all over her body. She died due to heart failure and breathing difficulties.

However a medical report authenticated by the Legal Affairs Department Director at the DHA and prepared by the medical committee on that case said: “There was no medical negligence and the patient was taken care of as it should be. However there was a legal violation of the UAE’s relevant federal law which strictly stipulates that a patient should be resuscitated.”

A letter from the health authority said the patient died after she was denied oxygen in respect to her family’s wish.

The next hearing is set for September 24.
