Kuwait - Man charged with sexual assault acquitted in appeal

(MENAFN - Arab Times) The Criminal Section in the Court of Appeals, chaired by Judge Hani Al-Hamdan, overturned verdict of the Court of First Instance which had sentenced a person charged with kidnapping and rape of a Kuwaiti woman to 10 years in jail with hard labor and immediate execution. This led to the acquittal of the accused



According to the defense counsel, Attorney Tareq Al-Khars; three female witnesses contradicted the statements of the supposed victim. They informed the court that they told the woman they will attend a party in a private building in Jabriya, but she urged them to give false impression to her husband that the venue was a hotel



They added she was aware the party was open to men and women, but she still opted to attend it. She arrived with a bottle of liquor which she brought out of her bag and consumed the entire content alone. She later had a misunderstanding with a woman and demanded to be left alone on top floor of the building with the accused. She went down later with the accused but she did not mention the alleged rape and she continued partying with other friends. In another case, the Court of Appeals upheld the verdict of the Court of First Instance, which had previously acquitted a Customs officer of involvement in the smuggling of ammunition and hashish from Iraq



Case files indicate an officer from the Drug Control General Department received information on the plan of an undisclosed person to smuggle ammunition and drugs from Iraq. However, the anti-narcotics officers did not find any evidence in his vehicle when they searched it, but the suspect himself admitted to smuggling a large quantity of hashish into the country through the border. The suspect then revealed that the customs officer provided easy passage for the contraband
