(MENAFN - Arab Times) The Court of Appeals presided over by Justice Fawzi Al-Waheeb upheld the ruling of a lower court and issued the final verdict by rejecting an appeal filed by a Kuwaiti woman against a doctor working in one public hospital, and ordered the appellant to pay the legal fee of KD 20



The Public Prosecution charged the defendant (the doctor) for allegedly raping the plaintiff, and misusing communication technology by sending indecent SMS to the plaintiff, inciting her to commit immorality. The case file indicated the plaintiff had demanded compensation of KD 10,000, but the lower court rejected the case on June 11, 2013, while in Dec 2013, the plaintiff appealed against the lower court verdict. Defense Attorney Professor Badr Jassem Al-Yaqoub presented his client's defense with evidence (a signed settlement) wherein the plaintiff relinquished all her legal rights pertaining to the case, including, the right to file lawsuit against the defendant



Based on the document, the court rejected the appeal. Meanwhile, in another case, the Court of Appeals, presided over by Judge Faisal Al-Khraibit, revoked the verdict of the Court of First Instance, which had previously sentenced an expatriate to one year and three months in jail with hard labor for attempting to break into a printing press; thereby, acquitting the accused. Case files indicate the accused tried to destroy the door of the printing press in an attempt to steal but the security guard foiled his plan, so he immediately escaped from the site



However, lawyer for the accused - Attorney Mohammed Al-Ajmi - raised doubt on the accusation; especially since the security guard did not recognize his client when the latter was presented to him. He then asked the court to acquit his client due to the absence of incriminating evidence. The higher court ruled in favor of the expatriate and affirmed his innocence after a thorough analysis of the arguments and proofs presented by both sides
