Kuwait - Court Obliges Plaintiff To Pay Legal Fees


(MENAFN- Arab Times) The Appeals Court presided over by Abdulsalam Al-Baijan canceled the verdict of the Court of First Instance which had obliged the Editor-in- Chief of the Arab Times and Al-Seyassah newspapers Ahmad Al-Jarallah to pay KD 200,000 in compensation to a member of the ruling family. The court again refused the petition and obliged the plaintiff to pay legal fees



In the petition, the plaintiff accused the defendant Al-Jarallah of insult through an article he published and using phrases that incited conflict among the ruling family members and literally causing harm to him



Earlier, the Court of First Instance issued a verdict obliging Al-Jarallah to pay KD 25,000 in compensation to harm caused the plaintiff due to the article he had published, but the plaintiff wasn't satisfied and appealed the verdict



Meanwhile, during a session on Dec 18, 2013, the Appeals Court issued the final verdict in which the appeal was canceled and the petition was rejected and the plaintiff was ordered to pay legal fees. Professor Dr Bader Jassem Al-Yaqoub had presented strong evidence to convince the court, and the final verdict was issued without haziness



According to the court, the article published by the defendant on April 17 focused on general issues which are of much concern to the public, as it shed light on issues that jeopardize the future of Kuwait through 'hidden fingers' playing with its internal policy. It also defended the right to demonstrate and called for the citizens to defend national stability, security and sovereignty of the nation and its peoples. It is worth mentioning Al-Yaqoub had attended all session



Therefore, Al-Seyassah and the Arab Times newspapers extend appreciation for his diligence efforts to defend freedom of opinion, the newspapers and journalism
