Kuwiat- Plea rejected


(MENAFN- Arab Times) The Appeals Court recently refused an appeal by the mother, who has custody of her daughters upon a court verdict to increase their sustenance, and instead gave the custody of the children to their father. Defense attorney Mubarak Al-Khashab told the court the second paragraph of Article No 190 of Law No 51/1984 was incorrectly interpreted. He clarified the paragraph includes two conditions for the man who is supposed to be granted custody of his daughters - the first he must be an unmarriageable person and the second he must have somebody (a woman) in whose custody the daughters can be entrusted. He clarified his client meets both the conditions. Since he is the father of the daughters, the second condition which stipulates the man should have a woman with him applies if the daughters are less than seven years old because they cannot do without their mother. But in the case of his client, the lawyer explained, the daughters are 15 and 18 years old. It is worth mentioning the Court of First Instance had turned down the petition of the mother asking to increase sustenance for the daughter. Moreover, the court had also turned down the petition of the father who was seeking the custody of his daughters.
