UAE- Panel rejects medical error allegation


(MENAFN- Khaleej Times)  Abu Dhabi Civil Court has dismissed a lawsuit filed by a patient against two health institutions and a doctor who works for them, demanding compensation for the damages he incurred when they failed to diagnose the disease he had been suffering from. In its ruling, the court said the ailment is a rare condition, which is difficult to diagnose, and added that the complications he experienced would not have differed had he been given a proper diagnosis and treatment. The patient had filed a suit against the three defendants for compensation for the material, moral, physical and psychological damages he had inflicted as a result of misdiagnoses. The patient was admitted to a hospital in 1999, and his case was diagnosed as meningitis. After two weeks under its care, his health improved and he was discharged from the hospital. In 2007 he moved to the alleged hospital again after feeling extremely weak and frail. One doctor said the patient was alert, but diagnosed palsy on the left side of the face. Another doctor concluded that the patient was suffering from BEST Syndrome, a hereditary form of progressive macular dystrophy - an eye disorder which can cause vision loss. When the health condition of the patient worsened due to the incorrect treatment being given, he was moved to another hospital, where his condition was diagnosed as Behçet's disease - a rare immune-mediated small-vessel systemic vasculitis that can cause ocular problems. The complainant did not show signs of any other symptoms and claimed that the mistake in the diagnosis and the unsuitable medication had caused him many other complications, including paralysis and a clot in the cerebral vascular pockets. The Court panel referred the case to a specialised medical committee. It maintained that the defendants had provided the necessary medical care to the complainant, and it was not proven there was negligence or medical error. The court rejected the case, arguing that the doctor took the right steps in looking after the patient.
